Mongolian Chamber of Commerce and Industry

Mongolian National Arbitration Court

The Mongolian National Arbitration Court (MNAC) is a non-governmental, non-profit organization that conducts private dispute resolution. It was founded on July 2, 1960 and forms part of the Mongolian National Chamber of Commerce and Industry (MNCCI).

On May 9, 2003 the Mongolian Parliament adopted a new arbitration law based on the UNCITRAL Model law on International Commercial Arbitration. This completes a long process of efforts to build an arbitration environment in Mongolia that caters for modern, domestic and international dispute settlement, meeting the needs of the national as well as the international business community.

MNAC also has 21 regional branches that are empowered to settle domestic disputes.

Functions / Activities / Services

The functions of MNAC are:

  • to promote and develop private dispute settlement mechanisms such as arbitration and mediation in Mongolia;
  • to supervise and to monitor activities of its branch arbitration centers;
  • to administer arbitration and mediation conducted under the Rules of Arbitration and Rules of Mediation of MNAC;
  • to provide legal consultation for interested persons in order to prevent disputes and educate about arbitration;
  • to conduct research and surveys on arbitration and mediation and organize training courses and seminars;
  • to promote arbitration and mediation;
  • to establish stimulating relationships and cooperation with arbitration institutions worldwide; and
  • to keep arbitral proceedings confidential and to administer arbitrations impartially, neutrally, fairly and promptly.

In order to advance and promote arbitration, MNAC conducts research on the laws, practices and developments of arbitration throughout the world. Publications include a quarterly Arbitration Magazine (in Mongolian) as well as handbooks and books on arbitration and private international law. MNAC was also actively involved in the preparation of Mongolia's arbitration legislation.

Other activities include organizing training courses and seminars on international law and arbitration among lawyers, arbitrators and businessmen. At MNAC's initiative there is an annual trilateral conference between MNAC, CIETAC and ICAC at the Russian Chamber of Commerce and Industry that has been running since 2000.

MNAC has many co-operation agreements with other arbitral institutions, and enjoys active cooperation with the ICC Court of Arbitration, LCIA and other distinguished institutions including the Stockholm Arbitral Institute, the German Institution of Arbitration and the International Arbitral Centre of Vienna.
