Japan Commercial Arbitration Association

The Japan Commercial Arbitration Association ("JCAA") was established in 1953 as a non-profit and financially independent organisation to promote the resolution of international and domestic commercial disputes through alternative dispute resolution. Over the last 50 years, the JCAA has been exerting its efforts to settle international commercial disputes by providing ADR services and has acquired high credibility among many corporations and other institutions around the world.

Japanese New Arbitration Law (Arbitration Law No.138 of 2003), which is modeled on the UNCITRAL Model Law on International Commercial Arbitration is widely recognised as the advanced arbitration statute in the world. The JCAA has updated its Commercial Arbitration Rules in conformity with the said Arbitration Law. The JCAA has employed international standards on arbitration proceedings in the New Rules and in practice including but not limited to appointment of arbitrators, competence of arbitral tribunal, interim measure, examination proceedings, taking of evidence, languages on arbitral proceedings, law applicable to substance of dispute, etc.

A foreign lawyers practicing outside of Japan and registered foreign attorneys in Japan (gaikokuho-jimu-bengoshi), under the Special Measures Law Concerning the Handling of Legal Matters by Foreign Lawyers (Foreign Lawyer¡¦s Act), may represent the parties to International Arbitration Proceedings in Japan. A party may appoint arbitrator on any nationality residing in and outside Japan and an arbitrator is not required any qualification.

 

Functions / Activities / Services

Arbitration
As the only permanent commercial arbitral institution in Japan, the mission of the JCAA is to promote the prevention and resolution of disputes arising from domestic and international business transactions. Through its transparent rules and procedures, the JCAA seeks to help all parties find a fair, quick and efficient resolution to a commercial dispute through arbitration.

Mediation
The JCAA provides mediation services, primarily for the settlement of domestic commercial disputes. The JCAA is also involved in developing educational materials for training mediators.

Consulting
The JCAA provides consulting services designed to prevent and resolve international commercial disputes. An attorney or international trade expert provide such services, depending on the nature of the business or dispute.

ATA Carnet
The JCAA has issued and guaranteed ATA Carnets under the ATA Convention covering the temporary admission of goods. These forms act as official international customs clearance documents, effectively providing a passport for goods (such as samples for a trade show) to cover 60 countries worldwide.
